The House Health and Human Resource Committee moves to amend
the bill on page two, section three, line fourteen, following the
word "isomers" and the period by inserting the following:
"(f) "Law enforcement agencies" means and is limited to:
(1) The state police and its members;
(2) A county sheriff and his or her law-enforcement deputies;
(3) A police department in any municipality as defined in
section two, article one, chapter eight of this code; and
(4) A federal DEA official who is investigating the
manufacture or distribution of methamphetamine."
And relettering the remaining definitions.
On page nine, section eight, line fifteen following the
word"section" and the period by adding the following:
"(d) Law enforcement agencies shall have access to this
central repository established by the Board of Pharmacy in this
section to determine those individuals who are purchasing a drug
product containing as its single active ingredient ephedrine,
pseudoephedrine or phenylpropanolamine or other designated
precursor that may be used along with other substances as a
component in the production and distribution of illegal
methamphetamine in an amount greater than the amount legally
allowed."
On page seven, section 14e, line seventeen, following the
word"services" by inserting the following:
"(4)Significant funding is potentially available under the
federal American Recovery and Reinvestment Act (Public Law 111-16)
to advance the purposes of this article if a state prepares to
implement health information technology in alignment with that Act
and provides necessary matching funds."
On page eight, section 14e, line four, following the word
"does" by inserting the word "not";
On page eight, section 14e, line fifteen, following the word
"chapter" by adding a comma and striking the word "or";
On page eight, section 14e, line sixteen following the
word"twenty"and the dash by striking out the word "six" and
inserting in lieu thereof the word "five";
On page eight, section 14e, line sixteen, following the word
chapter and the comma by striking the word "and" and inserting in
lieu thereof the word "or";
On page eight, section 14e, line 16, after "health TPA" by
inserting a period;
On page eight, section 14e, line sixteen following the period
by inserting the following:
"(5) "Health TPA"" and
renumbering the remaining definition;
On page nine, section 14e, line three, following the symbol
(A)by striking out the number 0.199 and inserting in lieu thereof
the number ".05;
On page nine, section 14e, line four after the word
"insurer"by inserting the words "on health insurance";
On page nine, section 14e, line eleven, following the word
"claims" by inserting the following:
"on health insurance for its West Virginia members";
On page eleven, section 14e, line one, following the word
'of"by striking the words"Health System Redesign" and inserting in
lieu thereof the words "Health Enhancement and Lifestyle Planning"
On page eleven, section 14e, line five, following the word
"fee" and the period by inserting the following:
"If at any time the Director of the Governor's Office of
Health Enhancement and Lifestyle Planning and the Director of WVHIN
determine that the assessment set forth in subdivision © will
produce funds exceeding those necessary to accomplish the purposes
of this article due to the availability of federal or other funds
for these purposes, the Director of WVHIN shall propose legislation
to reduce or eliminate the fee."
The House Health and Human Resource Committee further moves to
amend the enacting section to read as follows:
"That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §33-3-14e, to read as
follows" followed by a colon.
